Artificial intelligence (AI) is no longer a specialised technology reserved for a handful of tech companies. It now powers, at least tangentially, the tools, platforms, and processes of almost every business. AI’s presence in the workplace is now routine.

Organisations must ensure their employees know how to use AI responsibly, both as a compliance requirement and as a strategic capability. The goal should be to extract value from AI while staying within ethical and legal boundaries.

A New Baseline: AI Literacy for All

The EU AI Act is built around a tiered set of obligations, with requirements varying depending on the organisation’s role and the risks posed by the AI systems in use. The AI literacy obligation in Article 4 is a notable exception: it applies to all providers and deployers, regardless of the tools they use. In practice, this means almost every organisation in the EU is affected.

The provision in Article 4 requires ensuring a “sufficient level of AI literacy” among staff and others involved in operating or using AI systems on the organisation’s behalf. Under Article 3 para. 56, “AI literacy” is defined as the skills, knowledge, and understanding needed to make informed use of AI systems, recognise both opportunities and risks, and understand potential harm.

What This Means in Practice

The AI literacy obligation is not a blanket requirement to give every employee a generic AI course. The regulation calls for training and awareness measures to be based on two dimensions:

  • The risk and complexity of the AI system
  • The individual’s role and existing expertise

For example:

  • An AI engineer developing a proprietary model will need to understand how to ensure training data complies with data protection and intellectual property laws, mitigate bias in the training data, embed privacy by default and design for effective human oversight.
  • An HR professional using Microsoft Copilot for candidate screening needs a different focus: understanding discrimination risks, applying data minimisation from the user end, and recognising when human oversight is legally required.

Addressing Shadow AI

Risk assessments must extend beyond officially licensed AI tools. “Shadow AI”, as are called the unsanctioned AI services used by employees, introduces compliance and security risks. Staff might secretly use consumer-grade generative AI to summarise sensitive documents, process customer data, or generate code.

This needs to be factored into the literacy programme, either by clearly prohibiting such tools and/or by setting clear, enforceable risk mitigation measures.

How to Deliver AI Literacy

The Act is intentionally flexible on methodology. There is no prescribed format, certification, or duration. Organisations can adopt the delivery mechanism best suited to their corporate culture and resources.

Examples include:

  • In-person seminars for teams using high-risk AI or handling sensitive applications.
  • E-learning modules integrated into the company’s Learning Management System (LMS) for general awareness and role-specific training.
  • Blended learning where foundational AI concepts are taught online, followed by targeted workshops for higher-risk cases.
  • Tool-specific onboarding for employees with access to particular AI systems, covering both functionality and compliance boundaries.

For many organisations, embedding AI literacy training into an existing LMS will be the most cost-efficient method. However, a blended approach offers the best balance between broad coverage and targeted depth.

Why This Matters Now

The AI literacy obligation is already in force. Enforcement by national market surveillance authorities begins in August 2026, but waiting until then is risky. Misuse of AI tools today can already cause significant harm if employees act without understanding the implications.

Because the AI Act applies the proportionality principle, organisations that can demonstrate genuine literacy efforts will be in a stronger position if enforcement action arises. Regulators will weigh whether the company acted negligently or took reasonable steps to educate its staff.

Even outside the compliance and legal context, it is simply good business sense to ensure staff can use AI ethically and lawfully. Well-informed employees are far less likely to trigger problems in other high-risk areas such as data protection, intellectual property, labour, and competition law. They are also less likely to expose confidential information, share data with untrusted parties, or cause financial and reputational damage.

Conclusion

While AI literacy is a regulatory obligation, it is equally a sound business decision in an AI-driven corporate environment. The same measures that keep a company compliant can also reduce operational errors, prevent reputational harm, and enable staff to use AI to its full potential.
